Today, we are praying for Florida Governor Ron DeSantis, who has a weighty decision before him.  A growing contingent of people concerned about how hospitals treat COVID-19 is calling on Governor  DeSantis to veto a bill extending almost full immunity to hospitals treating COVID-19 patients. The bill seeks to extend a law that grants near-immunity to healthcare providers for their treatment of COVID-19, as long as they follow guidelines from the Centers for Disease Control and Prevention (CDC) and the National Institutes of Health (NIH). They say the measure still is needed to help healthcare facilities stay solvent during the pandemic. As Senator John Kennedy (R-LA) would say: “That’s a lot of hooey!”  Pray.

The original measure was passed in 2021 and is set to expire this March.  Now,  an extension bill is being pushed through the Florida House and Senate to extend the law’s special protections for healthcare providers through June 1, 2023.

DeSantis must decide whether to go along with lawmakers in his own party or push back in the way conservative groups hope he will, setting a powerful example for governors around the country.  In an election year, with 17 challengers vying for his job, that puts him in a tough spot. We invoke and pray the words of Romans 12:2 for Governor DeSantis  now, asking God to be with him in a special way and to inspire him as he deliberates this matter so that he will not be conformed to this world, but be transformed by the renewing of his mind, that he may prove what is that good and acceptable and perfect will of God.”  

We pray that God’s will be done in this matter, not only in Florida but in states across the nation. Pray.

Participants in medical freedom rallies across Florida and the rest of the country have decried hospital behavior in the treatment of COVID-19. Many families around the U.S. have asked courts to intervene and help them obtain treatments they wanted to try for their loved ones when all other government-recommended treatments had failed.

DeSantis recently said that he’s pushing Florida lawmakers to pass legislation that would allow doctors in his state to go against federal guidelines and prescribe what they think will work best for a patient. Pray.

Now, healthcare experts, political activists, families who’ve lost loved ones to COVID-19, and attorneys involved in recent healthcare battles to obtain alternative treatments have signed a letter that was hand-delivered February 14th to DeSantis’ office, asking him to veto the bill. The signers of the letter represent 21 organizations with members that number in the hundreds of thousands of Floridians.  

The letter’s author, attorney R. Shawn McBride, of the American Freedom Information Institute in Maitland, FL,

said that the letter’s signers don’t have a problem with giving healthcare providers protection from unfair lawsuits. Their problem with the law is that it ties liability protection for medical providers to their adherence to government guidelines in the treatment of COVID-19. That provision makes doctors and hospitals unwilling to try other treatments that may work better.

Families desperately want to try these other proven remedies, especially when all government recommended treatments have failed.  Pray.

The stipulation has “led to medical decisions and policies that are causing unnecessary deaths,” the letter states. “We must move to a better liability immunity system that leads to doctors getting to use the treatments they believe will work for their patients. SB 7014 does not accomplish this goal.”  The letter clearly states that the law “takes away patient choice and encourages health care providers to keep doing what they want to do.Pray.

Robert Malone, M.D., the virologist, and immunologist credited as the pioneer of mRNA vaccine technology used in the fight against COVID-19, was among the first to sign the letter to Governor DeSantis. Malone has become an outspoken opponent of vaccine mandates and created a social media firestorm after telling podcaster Joe Rogan that the United States is in the midst of a “mass formation psychosis” about the pandemic. “Mass formation psychosis” is when a large group of people unquestioningly allow their leaders to guide them and will continue to follow those leaders no matter what evidence emerges that conflicts with the leaders’ narrative. “The big concern is that the law is causing hospital group-think. It makes it scary for them to break away from CDC protocols. If they try emerging treatments, they lose liability protections.Pray.

Under the legislation, healthcare providers still can face lawsuits. But to prevail, plaintiffs have to prove “that the health care provider was grossly negligent or engaged in intentional misconduct.”  And that makes it practically impossible to sue medical providers, which can lower the standard of care.

Florida is one of 29 states across the country to enact laws shielding medical professionals from liability related to COVID-19. All 50 state governors were urged to put the protections in place by the federal government shortly after the pandemic began nearly two years ago, according to the American Medical Association (AMA). In Florida, it’s now up to DeSantis to decide whether to sign or veto the bill. Once lawmakers officially deliver it to him, he’ll have 7 days. If he vetoes the bill, the Legislature still could override his veto with a 2/3 vote. If DeSantis chooses to do nothing, the bill will become a law without his signature, and go into effect immediately. Pray.

Signers of the letter asking for a veto urged DeSantis to “create appropriate legislation that reflects our shared core values: protecting life, individual liberty and the freedom of medical choice. All of the signatory groups are taking action because we know better legislation will save lives and give patients the dignity of getting the treatment they desire.”

Lori Bontell traveled to Tallahassee on February 14 to deliver the letter to DeSantis’ office. For her, blocking the legislation is deeply personal, and it is her most heartfelt prayer that her Governor will veto it, she said. “I helplessly watched my sister die, as the hospital refused to provide life-saving treatments. They would only follow the CDC COVID protocols, which ultimately led to her death.  We aren’t against the healthcare providers. We just want patients to have the right to choose the treatments that they want and need and for their own doctors to have the freedom to exercise their independent medical judgment on a case-by-case basis to help their patients.  Otherwise, these unnecessary deaths will continue,” Bontell said. “Families like mine will be left to suffer the consequences of these protocols that several doctors have stated are outdated, ineffective, and lead to ventilation and death.”  Pray.

Dear Governor DeSantis: 

This letter is being sent to you on behalf of 21 freedom-loving organizations named below. Together we have hundreds of thousands of members/mailing lists/participants. Many of our supporters are the supporters that have voted for you in the past and hope to vote for you again in the future. 

Sitting on your desk is SB 7014 and our organizations are signing this letter – together – asking that you VETO that bill. 

SB 7014 will extend hospital indemnity of Florida Statute 768.381 through June 2023.  

Our organizations share the concern that the liability protections of 768.381 only kick in when the health care provider follows “government-issued health standards”.  

Government-issued health standards (or “treatment protocols”) include the CDC’s Covid-19  guidelines which many say aren’t working. Some medical professionals have stated that these CDC  protocols have led to unnecessary medicines, ventilation, and deaths. With SB 7014 in its current form, health care providers could simply follow the CDC’s guidelines against their patient’s wishes and remain free from liability

We know you share with us the core values of protecting life, individual liberty, and the freedom of medical choice. Yet what has happened – on countless occasions – and will continue to happen in  Florida if this law is adopted, is that Floridians are being denied treatment, checked into hospitals, and cut-off from their loved ones and medical decision-makers. At that point the patient loses control and the hospital uses the protocols they decide in many cases not even following the patient’s care decisions. 

Even in cases where the patient remains able to make decisions or their loved ones are active in the decision-making processes on their behalf the hospitals have often denied the patient their preferred treatment based on the hospital’s internal procedures. In such cases, the courts have been reluctant to allow hospital patients to use the treatments that they or their families wish. Indeed, in many cases, a patient has wanted to try a different treatment plan that their non-hospital doctor has requested and the hospital has not allowed the patient to receive those treatments.

Signing SB 7014 and extending liability protection based on following government treatment protocols will only make the system continue these practices. Patients will be denied innovative care and possibly die without getting to try the treatments they desire and need. Doctors will be afraid – or in some cases not permitted by the hospitals they work for – to do anything that is not within a “government-issued health standard”. 

Many groups have concluded that the liability protections currently in Florida Statute 768.381  (that SB 7014 extends) have led to medical decisions and policies that are causing unnecessary deaths. We must move to a better liability immunity system that leads to doctors getting to use the treatments they believe will work for their patients. SB 7014 does not accomplish this goal.  

Our groups stand united. We do not have an issue with health care provider liability protections that are correctly implemented. 

SB 7014 is not such a bill. SB 7014 takes away patient choice and encourages health care providers to keep doing what they want to do

We encourage you to immediately VETO SB 7014 so the legislature may reconsider the issue and create appropriate legislation that reflects our shared core values: protecting life, individual liberty, and the freedom of medical choice. 

All of the signatory groups are taking action because we know better legislation will save lives and give patients the dignity of getting the treatment they desire. 

Better legislation can be created that will allow Floridians that are being treated to get to work with the doctor of their choice using the treatment plan the patient wants to receive. In exchange for following the patient’s wishes, the doctor could, in turn, get liability protection for following the patient’s wishes. Those are the types of laws we need for Florida. And we will support that form of legislation.

Pray as the Spirit leads into what attorney McBride wrote…and that the Governor reads and responds! 

We pray:

  • That Governor DeSantis will VETO this bill immediately, as he continues to stand, front and center,  advocating for patient rights. Pray.
  • That those who are forced to go to a hospital will no longer have to fear losing their rights to the CDC protocols of being given Remdesivir…then put on a ventilator…then in a coffin! Pray.
  • That FL law will protect those hospitals, doctors, and nurses who refuse to accept and practice the CDC’s “death protocol” that everyone is put on whenever they go into a hospital!  Pray.
  • That patients will have the option of alternate methods of treatment, like high flow oxygen, injectable vitamin C and Vitamin D and Zinc, and proven drugs such as Ivermectin, Hydroxychloroquine, and Rosinal. Pray.
  • That the huge bonuses hospitals get from the federal government for “performing” according to their protocols… a positive PCR test, a COVID admission, they use Remdesivir, they use a ventilator and they get a pronunciation of  COVID on the death certificate…(which brings in over $100 K per person to the hospital) will no longer be paid. Pray.
  • That  Floridians will not tolerate  “massive murder for money” in the Sunshine State and are saying “NO!” to “KILLING FOR CASH!” Pray. 
  • Lord God, we continue to ask for protection for our nation, that we will not be drawn into a war. Let Your “peace that passes understanding” permeate the atmosphere around and above the nations involved, so they can settle these matters peaceably! Pray.
  • That our homes will get in order so that they might be places for His HABITATION and sanctuaries for others! Pray.
